Domestic Violence Protective Orders (50B)

Domestic violence matters require immediate attention, careful judgment, and strategic representation.  At BHH we are committed to ensuring that you and your children are protected.

In North Carolina, a person may seek a Domestic Violence Protective Order (“DVPO”), commonly referred to as a “50B,” when they have experienced domestic violence, have been threatened with imminent serious bodily harm, or have been subjected to conduct that causes substantial emotional distress within a qualifying relationship.

These proceedings move quickly and can carry significant personal and legal consequences.

Seeking Protection

A DVPO may:

  • Prohibit contact
  • Remove a defendant from the home
  • Address temporary custody or support
  • Restrict firearm possession
  • Provide other immediate protective relief

An emergency ex parte order of protection may be entered without notice to the other party, followed by a full hearing—typically within ten days—where both parties have the opportunity to present evidence.

These hearings are often fact-intensive and require careful preparation.

Defending Against a DVPO

Being named as a defendant in a 50B action can affect custody, employment, firearm rights, and your reputation. Allegations may intersect with pending or anticipated divorce and custody litigation.

Defending these cases requires prompt action, thorough factual development, and strategic evaluation of both short- and long-term implications.

Civil and Criminal Proceedings

Domestic violence cases may involve both civil protective order proceedings and criminal charges. The two processes are separate but can influence one another.

Understanding how these systems interact is critical when evaluating next steps.

Domestic violence cases are serious and often urgent. Our attorneys approach these matters with discretion, careful analysis, and measured advocacy.

Whether you are seeking protection or responding to allegations, we are prepared to advise you on your options and protect your interests.
